The renamed Starr County Drainage and Groundwater Conservation District handles drainage and groundwater conservation throughout Starr County. The separate groundwater district is dissolved, and its directors' terms end. Its assets, debts, contracts, employees, and records transfer to or continue with the combined district. The combined district must close the old district's affairs and file dissolution documents with the Texas Commission on Environmental Quality. County commissioners appoint five directors: an agricultural producer, a rural water supply employee, and municipal, active industrial, and county-at-large representatives. The producer must earn a substantial share of income from agricultural business in the district. Board service is not an added duty of a county commissioner. The act provides for immediate effect with two-thirds approval in each legislative chamber; otherwise, it takes effect September 1, 2025.
The combined district can impose a property tax throughout Starr County under Texas Water Code Chapter 49. The law does not set a tax rate or require the district to impose a tax. Property owners' costs depend on whether the district adopts a tax, the rate, and their taxable property value.
The district can contract with a municipality to take over its utility services, assets, facilities, debts, and other obligations. Neither side must enter a contract. District groundwater rules control conflicts with regional water authority rules or covered municipal utility and water or sewer corporation actions. Covered corporations must have an authorized service area wholly or partly within the district. In other conflicts, the regional authority's rule or the utility or corporation's action controls. The district cannot impose impact fees, standby fees, or assessments on electric, gas, telecommunications, cable, or advanced telecommunications provider property.
