Texas government security notices override contract limits

Contract terms cannot block, limit, or sidestep Texas state agencies’ or local governments’ required security incident notices. Conflicting terms are void and unenforceable in cybersecurity insurance contracts and other contracts for goods or services. The law clarifies existing law and adds no household notification duty. The act sets September 1, 2025, as its effective date unless two-thirds of each legislative house approved immediate effect.
