The law applies to Texas public-property leases signed on or after September 1, 2025, not existing leases. Leases must require tenants to obtain payment and performance bonds for contracts to build, alter, or repair property improvements. Payment bonds must meet Texas Property Code Chapter 53, Subchapter I standards. Performance bonds must equal the contract price and guarantee work follows the plans, specifications, and contract documents. Tenants must give the government notice of commencement at least 90 days before work begins. Leases with higher education institutions are exempt from the notice rule, but not the bond requirements.
