Harris County Municipal Utility District No. 405 can issue debt voters approved before land was excluded, without another authorizing election. Exclusion cannot weaken the rights of holders of outstanding district bonds, warrants, or other debt certificates. The district keeps its existing powers and duties. The law also validates its earlier governmental acts and proceedings. This excludes matters already invalidated by a final court judgment or involved in litigation that could ultimately invalidate them. The law provides immediate effect with approval from two-thirds of all elected members of each legislative house; otherwise, September 1, 2025.
Harris County Municipal Utility District No. 405 can make written deals with owners to remove undeveloped land. The board must find the terms favorable to the district. Only after those terms are met can the district issue an exclusion order, which must be recorded in Harris County property records. Once the order is issued, the land leaves the district and loses its right to district services. The land still owes its share of district debt, secured by liens until paid in full. The contract must state that share or explain how to calculate it. The district collects yearly debt-service taxes at the same rate as on land still inside the district. Those taxes remain pledged to district debt and must pay only the excluded land’s debt share. Owners can pay the remaining share in full at any time to end these taxes.
