Beginning September 1, 2025, Texas property owners' associations cannot use their governing documents to ban certain political meetings. Owners and residents can invite government officials or candidates qualified for the relevant election to speak in available common areas. These meetings can include association members, residents, and their guests. Associations can still apply their usual fees, deposits, occupancy limits, hours, meeting locations, and written reservation or rental agreements. The protection excludes spaces unavailable for meetings, including seasonal spaces or those reserved for association, board, or committee meetings. It also excludes associations that qualify for tax-exempt status under Section 501(c)(3).
