Beginning September 1, 2025, Texas public colleges and universities face limits on new private partnerships to build student housing. They cannot sign these contracts with private entities facing a pending legal action or lien against them or their property over a contractor’s, subcontractor’s, or vendor’s nonpayment claim. An exception applies if the entity provides a payment bond covering the claim. An exception also applies if the entity disputes the claim’s validity or accuracy in good faith. Contracts signed before September 1, 2025, remain governed by the law in effect when they were signed.
