For covered items sold beginning September 1, 2025, Texas limits bills from nonparticipating Medicare suppliers without written assignment. Assignment means agreeing to accept Medicare’s approved amount as payment. The rules cover durable medical equipment, orthotic devices and supplies, and prosthetic devices and supplies. Suppliers generally cannot charge more than 115% of Medicare’s approved amount. Higher charges require your written agreement before billing. Before receiving the item, you must also enter a rental payment plan or pay the excess in full. The agreement must state that Medicare reimburses 80% of its approved amount. It must also state that supplement plans need not cover charges above 115%. Violations are deceptive trade practices under Texas law. Intentional violations are misdemeanors carrying a $500 to $1,000 fine. Prosecution is allowed in Travis County or another county authorized by criminal procedure law.
Beginning September 1, 2025, Medicare supplement plans need not reimburse equipment charges above 115% of Medicare’s allowed amount. This applies to payments to enrollees or nonparticipating suppliers for covered durable medical equipment, orthotic devices and supplies, and prosthetic devices and supplies. Plans and suppliers can still negotiate the amount and type of reimbursement. Enrollees may have to pay some or all of the charges above that limit.
