Lower fees for builders who save water

Beginning January 1, 2026, Texas local governments must give builders and developers credits against water and wastewater impact fees. Credits cover constructing, contributing, or dedicating qualifying facilities, systems, or products that reuse or save water. Eligible measures reduce water use, supply needs, treatment or distribution needs, wastewater needs, or stormwater and drainage demand per service unit. Measures that exceed standard water-efficiency, reuse, or conservation requirements also qualify. Local governments must set fair, consistent procedures to calculate, apply, review, and approve credits. The law sets no credit amount and does not require savings to reach households.
