For conduct on or after September 1, 2025, Texas telephone solicitation rules cover sellers’ calls, texts, graphic messages, and images promoting purchases, rentals, or claiming or receiving items. Coverage also includes a buyer’s call responding to a solicitation sent by mail or another means. The law requires broad readings of Chapters 302 and 304 to protect people and the public against deceptive practices, including abusive telemarketing. People and public agencies can use Texas Deceptive Trade Practices Act rights and remedies to enforce Chapters 304 and 305. More than one past private recovery under Chapters 302, 304, or 305 does not itself limit recovery in future cases.
