Fresher credit reports for Texas insurance

The law took effect September 1, 2025, and covers personal property and casualty insurance policies delivered, issued for delivery, or renewed beginning January 1, 2026. Earlier policies remain under prior law. When credit information leads to an unfavorable decision, insurers must use reports issued within 90 days before first issuance or renewal. Within 30 days, insurers must give applicants or policyholders written or electronic notice explaining the action and reasons. Notices must include the credit reporting agency’s name, address, phone number, and toll-free number and website when applicable. They must explain the right to a free report within 60 days after notice and to dispute inaccurate or incomplete information. Insurers may include the right to request a policy review and new price when applicable. Notices no longer must explain that the reporting agency did not make the decision or cannot explain its specific reasons.

Credit reviews can change Texas insurance prices

These rules cover Texas personal property and casualty policies delivered, issued for delivery, or renewed beginning January 1, 2026. Insurers using credit scores must update credit reports at least every 36 months, reassess policy ratings, and adjust premiums. At renewal, you or your agent can request a new coverage and price review using a current credit report. Insurers must honor these requests, but not more than once every 12 months. Updated scores can raise or lower premiums. Insurers need not update scores and ratings for policyholders in the lowest-priced tier across their affiliated insurance companies. Updates also are not required when the policy or coverage type does not use credit scoring. Insurers may obtain credit scores under their underwriting guidelines at renewal before the 36-month period ends.
