New record rules for probate transfers

When a Texas probate case moves to another county, the transferring court clerk must send records through the electronic filing system. Required records include a transfer certificate, document index, final orders, signed transfer order, and copies of filed papers, including wills. The clerk must also send certificates and indexes from earlier transfers and a bill of accrued court costs. The original will must go by a qualified delivery method. This also applies to a paper copy offered to prove a will that cannot be produced in court. When applicable, the applicant who requested the transfer pays that delivery cost. The law applies to cases pending or started on or after September 1, 2025.
