Beginning September 1, 2025, Texas sets higher penalties for certain cultivated oyster farming offenses. Violating Parks and Wildlife Code Section 75.0104(a) or 75.0106 is a Class B Parks and Wildlife Code misdemeanor. It rises to Class A if trial evidence shows a prior conviction under Section 75.0107(b)(1) within five years before the current offense. Violating a Chapter 75 rule is a Class C Parks and Wildlife Code misdemeanor, rising to Class B if trial evidence shows two or more prior convictions for that type of offense within five years before the current offense. Earlier law still applies if any part of the offense occurred before September 1, 2025.
