More health support for Texas practitioners

Beginning September 1, 2025, the Texas Physician Health Program serves people in all occupations regulated by the Texas Medical Board. It is a confidential treatment program, not a disciplinary program. Anyone holding a board-issued license, certificate, registration, permit, or other work authorization can refer themselves. The program must accept these self-referrals.

Texas practitioners face required health program participation

The Texas Medical Board or an appropriate advisory board or committee can refer someone to the Physician Health Program. It can require participation before issuing or maintaining that person's license or other work authorization. Sections 167.009 and 167.0091 limit this authority.

Texas practitioner checks and physician profile updates

The Texas Medical Board must continuously check the National Practitioner Data Bank for people holding board-issued work authorizations. This applies when the database contains relevant information about the person. After finding new information about a physician, the board must update that physician's profile within 10 working days. Updates must add new disciplinary reports, correct existing reports, and remove reports of disciplinary actions dismissed or voided.

Added licensing fees for Texas practitioners

For applications submitted on or after December 1, 2025, the Texas Medical Board must collect two additional surcharges. One pays for continuous National Practitioner Data Bank checks when licenses or registration permits are issued or renewed; its amount is unspecified. The other adds up to $15 to each first-issue or renewal fee for a license, certificate, registration, permit, or other authorization. That money goes to a special General Revenue Fund account solely for the board's Physician Health Program administration, including an initial evaluation. It cannot pay participants' monitoring, medical costs, further required evaluations, or continuing care. Board fee caps are $900 for a license; $400 for a first registration permit or its renewal; and $200 for a temporary license or physician-in-training permit. Caps also include $600 for an outpatient anesthesia application and registration; $200 for an endorsement to another state's medical board or a duplicate license; and $700 to reinstate a license canceled for cause. The board must adopt implementing rules by December 1, 2025; earlier applications remain under prior law.
