New mediation deadlines for out-of-network health claims

Texas sets deadlines for out-of-network providers, health plan issuers, and plan administrators to request mandatory mediation of payment disputes. For services or supplies provided on or after the law’s effective date, the deadline is 180 days after the provider’s initial payment. For earlier services or supplies, requests must be made within 120 days after the effective date. Prior rules govern those older disputes; missing the 120-day deadline makes them ineligible for this mediation process. The law takes effect immediately with approval from two-thirds of all elected members of each legislative chamber; otherwise, September 1, 2025.
