3 provisions identified: 2 benefits, 0 costs, 1 mixed.
The comptroller must give the tobacco trust advisory committee an annual report on investment results and expected local government payments. The report must include changes to the investment policy or comptroller rules. The committee advises on investments and payment amounts, subject to that policy, laws, and rules. It also advises the health department and comptroller on their legal duties. These payments support local entities that provide indigent health care; the law sets no new household payment. The law also repeals Finance Code Chapter 395 and Government Code Sections 403.028(f), 403.1042, 403.602(14), 403.618, 404.108–404.113, and 490I.0110. The supplied text does not explain each repeal’s individual effect.
The investment board advises the comptroller and Texas Treasury Safekeeping Trust Company, without acting as a fiduciary. Members need finance knowledge or experience and must finish training before serving. Training covers managed assets, open meetings, and public information laws. A member or spouse cannot work for or help manage an organization receiving trust-company funds. They also cannot own or control more than 10% of such an organization. Receiving money from that organization above 5% of the recipient’s gross income in the prior calendar year also bars service.
Tobacco trust advisory committee members cannot receive pay from the state or trust fund for their service. They can be reimbursed for actual, necessary costs of attending committee meetings. Reimbursement also covers other official duties authorized by the comptroller. The law sets no reimbursement amount.
