The law took effect September 1, 2025, with new rules for surplus lines insurance policies covering risks wholly in Texas. The rules apply to policies with arbitration clauses delivered, issued for delivery, or renewed on or after January 1, 2026. Earlier policies remain under prior law. Arbitration must take place in Texas under Texas law, and Texas law must guide how the policy is interpreted. A different location requires the insurer’s written request, the policyholder’s later agreement, and a premium credit covering costs caused by the move; Texas law still applies. For policies with more than $2 million in insured value, both sides can instead agree to another location and another state’s law using the required agreement form.
