Texas-licensed money transfer companies cannot include fines or money penalties for breaking their terms of service. This protection covers agreements entered into on or after September 1, 2025; earlier agreements remain under prior law. Companies can still close accounts for violations if they refund the remaining balance and make the money readily available. A company that imposes a banned fine owes Texas a civil penalty of three times that amount, besides other available relief. The attorney general can sue to collect that penalty, plus attorney’s fees and court costs.
