More aquaculture facilities count as new

The law broadens which commercial aquaculture facilities count as “new,” based on when owners or operators first sought waste-discharge approval. Facilities qualify if they first sought approval from the Texas Natural Resource Conservation Commission after January 19, 1999. They also qualify if they first sought approval from the Texas Commission on Environmental Quality after December 31, 2003. This provision does not state what costs or requirements follow from that label.
