Beginning September 1, 2025, Texas construction trust fund protections extend to qualified recipients of transferred rights. These rights come from workers, contractors, subcontractors, and suppliers providing labor or materials for building or repairs on Texas property. To enforce a transfer of rights to unpaid trust funds, the recipient must first pay the original beneficiary in good and sufficient funds. The transfer must be in writing, separate from the beneficiary’s construction contract, and dated no earlier than that payment. The recipient must be a beneficiary, trustee, or property owner under the project’s construction or repair contract. Written notice must reach the property owner and project contractor within seven days after the transfer.
