More time for parents to enroll newborns

The law took effect September 1, 2025, and applies to Texas plans delivered, issued for delivery, or renewed starting January 1, 2026. Earlier plans stay under the prior law until renewal. For small-employer, large-employer, and multiple-employer plans, newborn coverage ends on day 61 after birth unless requirements for continued coverage are met. The child must remain eligible, and the plan must receive birth notice and any required extra premium by day 60. Plans offering maternity or newborn coverage cannot exclude or limit initial newborn coverage before day 61, birth-defect coverage, or required newborn screening tests. Screening test kit charges use the amount listed by the Texas Department of State Health Services for the test date.
