Beginning September 1, 2025, Texas health plans can change deductibles, copays, coinsurance, or other cost sharing to encourage certain providers. These incentives must mainly benefit members and cannot depend only on cost or shared ownership with the provider. Plans must use objective, accurate, verifiable information and take reasonable steps to avoid steering members to much lower-quality providers. They cannot limit access to medically necessary care or make materially false claims about provider quality or costs. Out-of-network emergency care cannot carry higher cost sharing than the same care in-network. Vision care plans are excluded.
Beginning September 1, 2025, Texas health plans can rank doctors only using standards from a state-designated medical specialty society or unbiased organization. Standards must stress care quality, use supported evidence, and explain their methods publicly. Standards based on patient outcomes must account for differences in patient risks. Plans must give affected doctors their rankings, methods, and affected products or networks at least 45 days before release. Doctors must have an easy way to report errors before release and verifiable false information afterward. When doctors provide enough proof of an error or violation, plans must fix it by the later of release or 30 days after receiving that proof. If the insurance commissioner finds a pattern of errors, falsehoods, or violations, the commissioner must ban that plan's use of the system for at least 12 consecutive months.
