Nurse exams can support involuntary treatment

Wisconsin allows qualified advanced practice registered nurses to examine people for court requests to override their right to refuse treatment. This applies after a final commitment order, except for people committed under the separate standard in section 51.20(1)(a)2.e. Starting the day after publication, a temporary rule allows exams by physicians or advanced practice registered nurses with psychiatric-care expertise. Beginning September 1, 2026, the nurse must also have authority to prescribe and psychiatric-care expertise through education or experience. A licensed physician must still sign a statement saying the person needs medication and cannot competently refuse it. Existing consent rights remain unless a court finds the person cannot competently refuse treatment or medication is necessary to prevent serious physical harm. An interested person files the motion, and the person's lawyer must receive notice. The court must hold a hearing within 10 days after filing; postponement requested by the person or their lawyer cannot extend beyond 20 days after filing. The person retains access to counsel, but there is no right to a jury trial at this hearing.
