New crisis safety plans for kids

Minors can make safety plans before behavioral or developmental health crises that could involve police or other emergency responders. A facilitator helps prepare the plan, which can list support contacts, warning signs, and ways to calm a crisis. The minor and facilitator sign it; it expires one year after signing. Portal sharing requires the minor’s signed release, and the facilitator must make sure the minor understands it. The release names current partners and explains that new partners may join and other networks may access it during crises. It stays attached until the plan expires or consent is revoked; revocation is not allowed during a crisis. Partners must keep plans confidential and access them only for crisis safety, review or updates, or the minor’s request. Disclosure to non-partners is limited to parents, guardians, legal custodians, Indian custodians, legal representatives, other portal networks during crises, or researchers using data without identifying details. The law takes effect the day after its publication or the second day after publication of the 2025 biennial budget act, whichever is later.

Statewide sharing of kids’ safety plans

Two or more people or organizations can form a network to share minors’ crisis safety plans. Partners must sign a formal agreement covering duties, training, and roles. Partners can include health providers, schools, county services, police, fire departments, emergency medical services, tribal agencies, and emergency dispatch centers. Milwaukee County child welfare services and the national suicide prevention and mental health crisis hotline center can also participate. Wisconsin’s Department of Health Services must develop and maintain a statewide portal, including availability in Milwaukee County. It can instead pay the nonprofit supporting the state’s electronic health information exchange to develop and maintain it. The law creates a portal funding line and authorizes 1.0 additional full-time position funded by general state revenue; no dollar amount is specified. The department must create a standard plan template. The portal must support online plan creation, printing for signatures, quick views for police, and controlled access for thousands of users. It must use cloud hosting that meets federal health privacy rules, track activity, and notify minors and facilitators about activity and approaching expiration. Plans can be shared across networks or restricted to their original network, with cross-network access during crises. The law takes effect the day after its publication or the second day after publication of the 2025 biennial budget act, whichever is later.
