Registered sex offenders can't live near child care

Beginning July 1, 2026, any person age 18 or older who must register as a sex offender cannot live within 1,000 feet of a child care facility. Distance is measured from the nearest point on the exterior wall of the offender’s dwelling to the facility’s property line. This rule does not apply if the offender lived at the address before July 1, 2026, or if the residence existed before the child care facility opened. A “child care facility” includes providers licensed by the Department of Family Services and government-run care that charges for services. It does not include elementary, middle, or high schools.

More notice to child care about offenders

Beginning July 1, 2026, when a registered offender was convicted of certain listed offenses, the sheriff or his designee gives notice to residential neighbors within at least 750 feet and to community groups like schools, religious, and youth groups. The state division also notifies each child care facility within at least 1,000 feet of the offender’s home. If an offender works at or attends an educational institution, the school can request notice to members of its campus community.

Official address checks for registered offenders

Beginning July 1, 2026, the state registry verifies a registered offender’s address to see if it is near a child care facility and whether any exception applies. If a registered offender asks, the county sheriff or the registry tells them whether an address is within 1,000 feet of a child care facility.
