§ 2510C. Confirming decision-making capacity [For application of this section, see 85 Del. Laws, c. 19, § 3]. (a) If an attending physician, attending APRN, consulting physician, or consulting APRN believes that an individual may not have decision-making capacity, the physician or APRN shall refer the individual to a psychiatrist or psychologist for evaluation of the individual’s decision-making capacity. (b) A psychiatrist or psychologist who evaluates an individual under this section shall communicate in writing, to the physician or APRN who requested the evaluation, the psychiatrist’s or psychologist’s conclusions about whether the individual has decision-making capacity to make an informed decision under this chapter. (c) If the psychiatrist or psychologist finds that the individual does not have decision-making capacity, the individual is not a qualified patient under this chapter and the attending physician or attending APRN must not prescribe medication to end life in a humane and dignified manner to the individual.85 Del.
