RELATING TO THE HAWAII NATIONAL GUARD.

Allows the commander of the Hawaii Air National Guard to hold the rank authorized by the Department of the Air Force. Provides the Adjutant General with the flexibility to assign either the Chief of Staff or the Assistant Adjutant General to lead the Hawaii Air National Guard. Authorizes the pay and allowances for the Chief of Staff of the Hawaii Air National Guard to be determined according to the pay tables of the Regular Air Force of the United States. RELATING TO THE HAWAII NATIONAL GUARD.

Authorizes the payment of allowances for TRICARE Reserve Select, TRICARE Dental Program, and vision coverage to all officers, warrant officers, and enlisted personnel of the Hawaii National Guard ordered to active duty for more than 30 days in the service of the State.

RELATING TO CONDOMINIUMS.

Clarifies the authority of condominium associations to impose fines for violations of the declaration, bylaws, house rules, or regulations adopted by the condominium association. Establishes a process for the unit owner or tenant of the unit owner to appeal the imposition of a fine. Clarifies the responsibilities of unit owners to pay common expense assessments. Clarifies the rights and process for unit owners to appeal assessments other than common expense assessments. Specifies that the Small Claims Division has exclusive jurisdiction over cases arising from condominium disputes regarding fines. Effective 7/1/3000. (HD1)

RELATING TO THE STABILIZATION OF PROPERTY INSURANCE.

RELATING TO VETERANS CEMETERIES.

Establishes the Veterans Cemeteries Board within the Office of Veterans Services of the Department of Defense to provide veterans cemeteries in the State with guidance, education, technical assistance, and other support to ensure compliance with standards set by the National Cemetery Administration of the United States Department of Veterans Affairs. RELATING TO THE STRENGTHEN HAWAII HOMES PROGRAM.

Establishes the Strengthen Hawaii Homes Program to encourage single-family homeowners to retrofit their homes to resist damage by providing for grants to help offset the cost of retrofits. Appropriates funds.

RELATING TO ADMINISTRATIVE LICENSURE ACTIONS AGAINST SEX OFFENDERS.

Includes, for purposes of the Money Transmitters Modernization Act, receivables due from payment processors for certain debit or credit card transactions. Clarifies the calculation of tangible net worth. Changes the initial annual fee assessed upon the submission of the application to an initial fee assessed upon the approval of the application. Expands and renames the Hawaii Renewable Hydrogen Program to include identification of likely pumped storage hydropower locations, or sites for other long duration clean energy storage technologies, and promotion of their development. Expands the use of the Hydrogen Investment Special Fund to include seed capital and venture capital investments for the Hawaii Renewable Hydrogen and Long Duration Clean Energy Storage Program. RELATING TO TRANSPORTATION.

Prohibits the issuance of a certificate of inspection for a moped or motor vehicle that has been altered, installed, or otherwise modified in any way which will noticeably increase the noise emitted by the motor vehicle or moped above that emitted by the motor vehicle or moped as equipped from the factory, except for motorcycles and mopeds that do not exceed certain federal regulations. Requires the Office of Planning and Sustainable Development to conduct an integrated land use study for the use of lands within the agricultural districts. Establishes one full-time equivalent (1.0 FTE) planner position, exempt from chapter 76.

RELATING TO TAXATION.

Authorizes the use of county surcharge revenues for transportation and housing infrastructure in counties having a population of 500,000 or less. Authorizes counties that have previously adopted a surcharge on state tax ordinance after July 1, 2015, to amend the uses of the surcharge. Extends the period within which a county with a population of 500,000 or less may collect a surcharge on state tax, under certain conditions, to 12/31/2047. Authorizes cost-sharing with private or other public developers for housing infrastructure projects funded by surcharge revenues.

RELATING TO IMPORTANT AGRICULTURAL LANDS.

Establishes an important agricultural lands incentive to provide alternative means to develop housing for farmers and farm employees. Authorizes a landowner or lessee of important agricultural lands to apply to a county for a permit allowing the landowner or lessee to develop, construct, and maintain farm cluster housing. Requires each county to enact ordinances to allow farm cluster housing on important agricultural lands. Establishes requirements for farm cluster housing. Repeals existing requirements for farm dwellings and employee housing on important agricultural lands. Effective 7/1/3000. (HD1)

RELATING TO THE HAWAII TECHNOLOGY DEVELOPMENT CORPORATION.

Increases the cap for awards to assist businesses applying for the Small Business Innovation Research Grant Program and the Small Business Technology Transfer Grant Program of the Hawaii Technology Development Corporation. Adds purchasing of renewable energy systems as an eligible expense and clarifies that training on both new and existing manufacturing equipment is an eligible expense for the Manufacturing Development Grant Program. Clarifies that no tax credit is available for renewable energy systems purchased with a grant received under the Manufacturing Development Grant Program.

RELATING TO THE LAND STUDY BUREAU SOIL RATING SYSTEM.

Requires the Office of Planning and Sustainable Development, in coordination with other agencies, to update the soil data used in the land study bureau soil rating system and create a mechanism for regular soil data updates. Appropriates funds.

RELATING TO THE RENTAL HOUSING REVOLVING FUND.

Creates a mixed-income rental housing subaccount under the Rental Housing Revolving Fund which shall make loans to mixed-income rental projects or units in a mixed-income rental project. Authorizes the transfer of moneys from the Rental Housing Revolving Fund to the Rental Housing Revolving Fund Mixed-Income Subaccount.

RELATING TO FIREWORKS.

Amends multiple definitions and penalties for fireworks offenses, including heightened penalties if another person suffers substantial bodily injury, serious bodily injury, or death as a result of the fireworks offenses. Establishes criminal offenses of general fireworks or articles pyrotechnic prohibitions in the first and second degree; sending or receiving fireworks or articles pyrotechnic by air delivery; distributing fireworks or articles pyrotechnic to non-permit holder; removal or extraction of pyrotechnic contents; consumer fireworks prohibitions; refusal to provide identification; and violating requirements of carrier. Establishes an adjudication system and procedures to process fireworks infractions; makes an appropriation.

RELATING TO THE AGRIBUSINESS DEVELOPMENT CORPORATION.

Includes agricultural tourism in the definition of "enterprise" to authorize the Agribusiness Development Corporation to financially support farming businesses engaged in agricultural tourism. RELATING TO MENTAL HEALTH.

Clarifies and expands the circumstances and procedures available for emergency transportation, examination, and hospitalization under chapter 334. Provides limits on liability for state and local governments and professionals during mental health emergency procedures while performing their duties in the course of employment. Expands the notice requirements for an emergency hospitalization to include an individual's health-care surrogate and clarifies when notice to family members can be waived. Removes the authority of the family court to appoint a legal guardian in a proceeding for involuntary hospitalization. Removes the requirement that psychiatric facilities wait for a response on a notice of intent to discharge an involuntary hospitalization patient prior to discharge. Clarifies the circumstances under which a subject of an order for assisted community treatment can be administered medication over the subject's objection. Provides limits on liability for an assisted community treatment provider. Modifies the administrative authorization of medical treatment over the patient's objection to be reviewed by a single decision-maker who is a psychiatrist.

Requires that the Attorney General's identification system include criminal cases initiated via citations that resulted in conviction, deferred acceptance of guilty or nolo contendere plea, or conditional discharge, and that a court order identification processing in such cases.
