Provides that one of the directors of the Commuter Rail Board shall be a person with a disability who uses the services provided by the Commuter Rail Division and appointed with the advice and recommendation of a disability advocacy organization serving the Metropolitan Region. Provides that the Chicago Transit Authority, the Suburban Bus Board, and the Commuter Rail Board shall each establish and maintain an ADA Advisory Committee to advise the Chicago Transit Authority, the Suburban Bus Board, or the Commuter Rail Board on accessibility and compliance with the Americans with Disabilities Act of 1990 as it relates to fixed route and paratransit service.

Provides that the corporate authorities of a county may only provide a hotel with permission to operate as a refugee shelter for a period of not more than 2 years. Provides that the corporate authorities of a county may renew a hotel's permission to operate as a refugee shelter. Provides that the corporate authorities of a county shall require a hotel operating as a refugee shelter to comply with the zoning laws of the county. Amends the Illinois Municipal Code. ENTERTAINMENT WATER ACCESS
Creates the Entertainment Water Access Act. Requires places of entertainment to provide attendees with access to potable water while entertainment is occurring by: (1) providing bottled water at no cost; (2) allowing attendees to bring bottled water; or (3) allowing attendees to bring an empty bottle and providing free water for refilling. Requires the Attorney General to enforce the Act, and allows the Attorney General to provide information to owners and operators of places of entertainment. Amends the Wellness and Oversight for Psychological Resources Act. Defines "qualified research program". Provides that the prohibitions on unauthorized therapy services under the Act shall not apply to artificial intelligence-assisted therapy or psychotherapy services provided exclusively within a qualified research program. Sets forth requirements for qualified research programs. Requires a licensed professional participating in a qualified research program to perform certain actions. Provides that academic medical centers shall register existing research programs that meet the criteria for qualified research programs within 90 days after the effective date of the amendatory Act. Provides that the exemption shall apply only to services provided within the context of an approved research protocol and shall not extend to certain services. Sets forth requirements for academic medical centers conducting qualified research programs. Provides that research participants shall not be denied access to standard care as a condition of participating in research involving artificial intelligence-assisted therapy. Sets forth requirements for the Department of Financial and Professional Regulation. Provides penalties for any academic medical center or licensed professional found to have misrepresented a commercial service as qualifying for the research exemption, or to have otherwise violated the requirements of the amendatory Act. Requires the Department to submit a report to the General Assembly evaluating aspects of the qualified research programs. Repeals the provisions on January 1, 2030. Makes other changes.

Amends the Criminal Code of 2012. Provides that a first responder who reasonably believes that a person's presence within 14 feet of the first responder will interfere with the performance of the first responder's legal duty may warn the person not to approach or to remain within 14 feet of the first responder. Provides that it is unlawful for a person, after receiving a warning not to approach from a first responder who is engaged in the lawful performance of a legal duty, to knowingly or intentionally violate the warning and approach or remain within 14 feet of the first responder with the intent to: (1) interrupt, disrupt, hinder, impede, or interfere with the first responder's ability to perform the first responder's legal duty; (2) threaten the first responder with physical harm; or (3) harass the first responder by interfering with the first responder performing the first responder's legal duty. Amends the Child Care Act of 1969. Amends the Unified Code of Corrections. Restores the general recidivism provisions of the Code before the effective date of Public Act 101-652. Provides that the third-time offender provisions resulting in a sentence of natural life imprisonment apply when the defendant has attained the age of 18 at the time of the third offense (rather than 21 years of age or older when the first offense was committed). In the provision that when a defendant, over the age of 21 years, is convicted of a Class 1 or Class 2 forcible felony after having twice been convicted in any state or federal court of an offense that contains the same elements as an offense now (the date the Class 1 or Class 2 forcible felony was committed) classified in Illinois as a Class 2 or greater Class forcible felony and those charges are separately brought and tried and arise out of different series of acts, that defendant shall be sentenced as a Class X offender, provides that the 3 offenses may be felonies rather than forcible felonies. Provides that the Class X sentencing provision does not apply to Class 1 or Class 2 felony convictions for theft.

Amends the Illinois Income Tax Act. Provides that the rate of tax on individuals, trusts, and estates shall be (i) 4.5667% of the taxpayer's net income for taxable years beginning on or after January 1, 2026 and ending before January 1, 2027, (ii) 4.1833% of the taxpayer's net income for taxable years beginning on or after January 1, 2027 and ending before January 1, 2028, and (iii) 3.8% of the taxpayer's net income for taxable years beginning on or after January 1, 2028 (currently, 4.95%). Provides that the amendatory Act may be referred to as the Reproductive Liberty and Justice Act. Amends the Equity and Representation in Health Care Act. Expands the definition of "medical facility" to include a reproductive health center established at a nonprofit community health center. Makes other changes. Amends the Birth Center Licensing Act. Makes changes to the definition of "birth center". Provides that a birth center and any licensed provider of abortion and birth control services on site may be colocated at the same facility. Removes from the definition of "neglected child" any child who is a newborn infant whose blood, urine, or meconium contains any amount of a controlled substance. Makes corresponding changes to the Juvenile Court Act of 1987, the Adoption Act, and the Vital Records Act. Contains provisions concerning CAPTA notifications and prohibited disclosures regarding the results of a toxicology test administered on a newborn or a pregnant person. Amends the Article in the Illinois Trust Code governing the duties and powers of trustees to provide a procedure for settlement of accounts. Provides that a trustee may obtain a settlement of its accounts if a trust terminates under the terms of the trust, a trust terminates early, a trustee resigns or is removed, or a trustee seeks discharge of an interim accounting period if the interest of one or more beneficiaries has terminated and the trust is continuing. Provides that a trustee who elects to use the new provisions must provide notice and a statement of information to the qualified beneficiaries of the trust and the successor trustee, if applicable, within a reasonable time after termination of the trust under its terms, the resignation or removal of the trustee, or the end of the period for which the trustee is seeking discharge. Provides that, if, after receiving the notice and trust information, a qualified beneficiary or any other party that received the notice and trust information objects to a disclosed act or omission, the qualified beneficiary must provide written notice of the objection to the trustee not later than 60 days after the notice was sent by the trustee. Provides that, if no written objection is provided in the 60-day time period, the information provided is considered approved by the recipient. Requires the trustee, in the case of a trust terminating under the terms of the trust or the trustee's resignation or removal, within a reasonable period of time following the expiration of the 60-day time period, to distribute the assets as provided in the trust or to the successor trustee. Provides that, if a qualified beneficiary gives the trustee a written objection within the applicable 60-day time period, the trustee or the qualified beneficiary may (i) submit the written objection to the court for resolution and charge the expense of commencing a proceeding to the trust or (ii) resolve the objection by a nonjudicial settlement agreement or other written agreement. POWER OF ATTY-PATIENT RIGHTS
Amends the Illinois Power of Attorney Act. Creates rights for patients with a health power of attorney. Provides that all individuals undergoing surgery, hospitalization, or any medical procedure shall have the right to designate a designated representative in a health care power of attorney on their behalf in the event of incapacitation. Provides that patients and their designated representatives are guaranteed the following rights: (1) the right to receive clear, comprehensive information about proposed treatments, including risks, benefits, and alternatives, in a language and format they understand, before agreeing to any procedure; (2) the right to view, request, and receive copies of all medical records, and the assurance of confidentiality in accordance with Health Insurance Portability and Accountability Act and related privacy laws; (3) the right to appeal medical decisions, including denial of treatment, discharge, or transfer; (4) the right to request and receive a second opinion from another qualified medical professional or specialist, including those outside the treating facility, without fear of delay, retaliation, or obstruction; and (5) the right to medical interpretation services for patients or their designated representative who do not speak or understand English fluently, including access to certified medical translators and translated documents, at no cost to the patient. Creates a State Patient Rights and Advocacy Commission to oversee implementation of the Act, monitor compliance by health care providers, and respond to violations. Provides that any health care provider or institution found to be in violation of the Act is subject to disciplinary sanctions, which may include: civil fines; suspension or revocation of professional licenses; facility accreditation review or suspension; and mandatory corrective action plans and staff retraining.

Amends the Downstate Forest Preserve District Act. Provides that the Board of the Kendall County Forest Preserve District may impose a tax upon all persons engaged in the business of selling, including leasing, tangible personal property, other than personal property titled or registered with an agency of this State's government, at retail in the county on the gross receipts from the sales made in the course of business to provide revenue to be used by the forest preserve district in that county for general forest preserve district purposes. Provides that the tax may not be imposed on tangible personal property taxed at the 1% rate under the Retailers' Occupation Tax Act. Provides that the tax shall not be imposed on sales of aviation fuel for so long as the revenue use requirements are binding on the board. Changes the definition of "gambling device" to include any vending or other electronic machine or device, including, without limitation, a machine or device that awards credits and contains a circuit, meter, or switch capable of removing and recording the removal of credits that offers a person entry into any contest, competition, sweepstakes, scheme, plan, or other selection process that involves or is dependent upon an element of chance for which the person may receive a gift, award, or other item or service of value if that offer is incidental to or results from: (A) the purchase of an item or service of value; or (B) the purchase or gratuitous receipt of a coupon, voucher, certificate, or other similar credit that can be redeemed for or applied towards an item or service of value from such machine or device or elsewhere. Provides that a person shall not be convicted of gambling if the person participates in a game of skill or chance where money or other things of value can be won but no payment or purchase is required to participate, except where conducted through the use of a gambling device or by means of the Internet. Provides that a gambling offense involving such a gambling device is a Class 4 felony. Amends the Video Gaming Act. Removes a provision allowing for the use of a game device without a license if the game device is used in an activity that is not gambling under the Criminal Code of 2012. Effective immediately.

Amends the Sports Wagering Act. Provides that applicants for a master sports wagering license shall pay an application fee of $250,000 and a license fee of $15,000,000. Removes provisions concerning the number of master sports wagering licenses to online sports wagering operators and public notice requirements. Provides that a master sports wagering licensee may conduct sports wagering over the Internet or through a mobile application. Removes provisions concerning eligibility requirements for a master sports wagering license, the duty of disclosure for an applicant, and outreach requirements for the Department of Commerce and Economic Opportunity and the Illinois Gaming Board. Makes a conforming change. Effective immediately.

STATE GROUP INS-DEPENDENTS
Amends the State Employees Group Insurance Act of 1971. Provides that if both spouses are eligible covered members and are employees under the State Employees Article of the Illinois Pension Code, then one spouse may enroll the other spouse as an eligible dependent if: (1) both spouses provide to the Department of Central Management Services, upon the request of the Department of Central Management Services, an attestation that the member and the member's spouse have elected for the spouse to be enrolled as a dependent; and (2) the spouses continue to be married. Provides that upon electing to enroll in the program of group health benefits as an eligible dependent under the amendatory provisions, a member forfeits his or her rights as a member under the Act with respect to the program of group health benefits during the period when that election is in effect. FIXING HIGHER ED FUNDING ACT
Creates the Fixing Illinois Higher Education Funding Act. Requires the Board of Higher Education to study the cost drivers of State universities and develop a comprehensive, 10-year plan to ensure the long-term performance and sustainability of higher education in the State that ensures funding supports education outcomes, assesses the affordability of higher education for students, and supports long-term economic and workforce development goals. Sets forth factors to be studied. Requires the Board to issue a report based on the findings of the study to the Governor and the General Assembly no later than March 31, 2027. Effective immediately.

PROCUREMENT-NO DEFORESTATION
Amends the Illinois Procurement Code. Creates the Deforestation-Free Illinois Law within the Code. Provides that neither the State nor any State agency shall allow any person having a contract with the State or with a State agency to purchase, at wholesale or retail, or obtain any tropical hardwood or tropical hardwood product for use in completing a contract with the State or with any State agency, subject to certain exceptions. Requires contractors who enter into contracts with the State to certify that the commodity furnished to the State was not extracted from, grown, derived, harvested, reared, or produced on land where deforestation or primary forest and old-growth forest degradation occurred. Effective immediately.

INDUSTRIAL HEMP ACT
Amends the Illinois Income Tax Act. Creates a corporate income tax deduction for hemp business establishments in an amount equal to 50% of the income generated by the sale of products made by businesses owned by minority and other specific priority-population-owned businesses. Amends the Tobacco Products Tax Act of 1995 to exclude hemp-cannabinoid products subject to tax under the Industrial Hemp Act from the definition of tobacco products. Amends the Liquor Control Act of 1934 to provide that hemp extract and hemp-cannabinoid products made in compliance with State law are considered fit for human consumption. Authorizes liquor license holders to manufacture, distribute, and sell such products. Amends the Industrial Hemp Act to establish a comprehensive regulatory framework for hemp and hemp-derived cannabinoid products, including licensing, registration, packaging and labeling standards, age verification, laboratory testing, recordkeeping, enforcement, and penalties. Creates the Hemp Social Equity Fund to support loans, grants, and technical assistance for social equity applicants. Makes conforming changes to the State Finance Act. Effective January 1, 2027.

Amends the State Comptroller Act. Prohibits the State Comptroller from withholding, offsetting, or otherwise applying against any debt any funds payable to a unit of local government if those funds are restricted for a specific purpose by federal or State law, county ordinance, or grant agreement. Amends the Public Construction Bond Act. Provides that the Department of Transportation and the Illinois State Toll Highway Authority shall require every contractor for public works to furnish, supply, and deliver a bond if the public works contract will cost more than $10,000,000 (currently, $500,000). Provides that local governmental units shall require a bond for public works projects costing over $5,000,000 (currently, $150,000) and may require a bond for public works projects valued at $5,000,000 or less (currently, $150,000 or less). Provides that certain bonding requirements apply until January 1, 2034 (currently, January 1, 2029).

CHATBOT PROVIDER-LIABILITY
Creates the Chatbot Provider Liability Act. Provides that for purposes of the Act, chatbots are deemed products for the purpose of strict liability as other product liability actions. Provides that a chatbot provider has a duty to ensure that the use of its chatbot does not cause injury to a user and is liable for any injury it caused a user through the use of its chatbot regardless of whether the chatbot provider exercised all reasonable care in the design and distribution of the chatbot; or did not directly distribute the chatbot to the user or otherwise enter into a contractual relationship with the user. Provides that a user who is harmed by the actions of a chatbot provider under this Act may file a civil action in State or federal court seeking actual damages as allowed under Illinois law, injunctive relief, and reimbursement of reasonable attorney's fees and costs.

ELECTRONIC PRESCRIPTIONS
Amends the Illinois Controlled Substances Act. Provides that, if a pharmacy is unable to fill an initial prescription received electronically because the prescribed drug is not in stock, the dispenser must immediately contact the patient to notify the patient of the situation and ask if the patient would like the prescription transferred electronically to a pharmacy of the patient's choosing, consistent with federal regulations concerning the prescribing of controlled substances. Provides that the prescriber shall not be required to issue prescriptions electronically if the prescriptions need to be filled outside of typical retail pharmacy operating hours or may be difficult to obtain because of drug shortages or pharmacy inventory limitations. Amends the Pharmacy Practice Act to make conforming changes. Effective immediately.

GAMING-PRIZE & GIFT KIOSK
Amends the Video Gaming Act. Provides that an applicant or licensee is not in violation of the Act or any rule of the Board and the applicant or licensee is not subject to disciplinary action, delay of Board consideration, or denial of any license based solely upon the ownership, operation, or possession of a game device if the game device is in compliance with specified Sections of the Criminal Code of 2012. Amends the Criminal Code of 2012. Provides that, notwithstanding any other gambling offense provisions, a gambling offense involving a specified vending or other electronic machine or device connected to the Internet is a Class 4 felony. Prohibits any municipality from imposing any restriction or prohibition on permitted gambling activities. Makes changes to the definition of "gambling device". Amends the Prizes and Gifts Act. Makes changes to defined terms. Sets forth provisions concerning the operation of a prize and gift kiosk. Requires each business operating a prize and gift kiosk to be registered with the Department of Revenue and to register each prize and gift kiosk as a Coin-Operated Amusement Device. Provides that filing for a device other than a prize and gift kiosk shall be considered filing a false report or form with the State, and violators shall be subject to any and all penalties for that violation. Provides that the Department of Revenue and the Illinois Liquor Control Commission or its designee shall have jurisdiction. Effective immediately.
