In accordance with Legislative Resolve (H.P. 857 – L.D. 1322) the Department of Inland Fisheries and Wildlife (MDIFW) is proposing to establish a 2-year pilot program to increase youth participation in hunting. Part of this resolve entails establishing a 2-day youth bear hunting season on a Friday and Saturday, as well as establishing a day for youth hunting with dogs prior to the opening of the regular season for hunting with dogs. The resolve also directs MDIFW to increase availability for youth turkey hunters by establishing a long weekend or a 2-day season on a Friday and Saturday. As directed, this would be a pilot program for two years during the 2026 and 2027 hunting seasons.

The Department of Health and Human Services (Department) proposes to establish this rule to implement several requirements in accordance with the settlement agreement between the United States of America and the State of Maine (U.S. District Court, District of Maine, Case 1:24-cv-00315-SDN), effective December 20, 2024 (the “Agreement”), which is intended to prevent children with behavioral health disabilities from entering or remaining in an out-of-home placement. The proposed provider requirements include, but are not limited to, offering to and referring members under age 21 to a Single Assessment, delivering timely services, adopting contingency staffing plans, and having appropriate training in evidence-based models. This rule also includes an overview of the Single Assessment which the Department will use to determine the clinically appropriate level of care for members under age 21 and to determine eligibility for medium and high intensity behavioral health services for children.

This rule would implement a Maine EMS Code of Ethics specific to the needs of EMS in the State of Maine, and would make a violation of this code a violation of rules related to professional conduct. This rule adds specificity to the statutory authority related to ordering physical or mental examinations, clarifying that such an examination is ordered during an investigation into a complaint or concern, that a licensee bears the cost of an examination, and provides a process to petition the Licensing Board to waive such expense.

Prior to enactment of P.L. 2023, ch. 16, the owner or operator of an underground storage tank (UST) used to store motor fuels or in the marketing and distribution of fuels was required to remove the tank and all associated piping from service upon expiration of the tank manufacturer's warranty, except that a double-walled UST was allowed to continue to be in service for up to 10 years beyond the expiration of the warranty, provided tightness testing was conducted to verify the integrity of the tank and the facility was brought up to current standards.

Federal rules require that income and asset allowances, standard shelter deductions, and minimum and maximum benefit limits, are updated each year, effective October 1st. The U.S.D.A. - Food and Nutrition Services (F.N.S.) provides updated income and asset allowances, standard deductions, and minimum and maximum benefit standards. F.N.S. annually approves utility allowances calculated by states. The utility allowances proposed in this rule are based on current typical utility expenses for low-income Mainers and may be adjusted prior to adoption based on F.N.S. guidance and final approval. The Department proposes to incorporate these figures effective October 1, 2025. These changes would make SNAP benefits and the related SNAP Employment and Training (E&T) services available to more Maine households.
