Due to the delay of gasoline deliveries caused the cyberattack on the Colonial Pipelines computer network system , The Department issues this temporary rule to provide a waiver for ASTM Reid Vapor Pressure Specifications related to gasoline and gasoline blended with one or more percent ethanol. The reasoning for this waiver is to avoid supply disruptions for Mississippi and other states affected by the cyber attack through June 6, 2021 or until supplies are depleted. This should provide a greater supply of gasoline for sale in the state.

Title 35.II.3.16 Calculation of Permit Fees is a new regulation that clarifies the requirements for determining applicable privilege license tax.

Paragraph 108 was amended to clarify that permitted sales may include orders and payment through the telephone or electronically with curbside pickup for customers in the parking lot. Paragraph 111 was amended to include small craft breweries and microbreweries to the list of businesses that may be issued on-premises permits. This statutory change can be found in HB 1091 in the 2021 Regular Session. Other minor changes were made.

Title 35.II.4.11 Retail Pickup from Distilleries and Native Wineries is a new regulation that clarifies the requirements for retail permittees picking up native wines and spirits sold by the Department of Revenue found in Miss. Code Ann Section 67-1-41(10).

Implementation of TANF Increase in Senate Bill 2759 signed by Governor Tate Reeves on 3-24-2021 amending Mississippi Code Ann. § 43-17-5. Per Senate Bill 2759 the act shall take effect and be in force from and after its passage. The Mississippi Community College Board is updating the Mississippi High School Equivalency Program State Policy to reflect updated testing prices for the GED test. These prices are set by the company. The proposed change also deletes references to the TASC option as it is no longer available. This policy is being submitted for initial public comment.
