(1) There is a state fire prevention and investigation section in the department of justice and under the supervision and control of the attorney general. (2) A person appointed to administer the fire prevention and investigation section shall represent the state of Montana as the state fire marshal and must be a person qualified by experience, training, and high professional competence in matters of fire service and safety.
