Rule Making Activitiess

Subject: Statewide protocols for diapering and toileting. Purpose: To implement chapter 361 of the Laws of 2024.

Subject: Outreach for the supplemental nutrition assistance program. Purpose: To implement Part B of chapter 56 of the Laws of 2025.

Subject: Establishing a program review process for teacher preparation programs. Purpose: Strengthen quality assurance of teacher preparation programs and determine if programs meet pedagogical core requirements.

Subject: Automated External Defibrillators and School Cardiac- Emergency Response plans. Purpose: To ensure the regulations are in compliance with chapter 189 of the Laws of 2025 and chapter 422 of the Laws of 2025.

Subject: Transferring of Prescriptions by Pharmacists. Purpose: Require pharmacists and pharmacies to transfer a patient’s entire prescription, including all authorized refills, upon request.

Subject: Part-time Study for Undergraduate Students. Purpose: Conform regulations to 2025-26 enacted State budget changes to the part-time tuition assistance program and expand eligibility.

Subject: Registered pharmacy technicians’ practice settings. Purpose: To implement chapter 543 of the Laws of 2025.

Subject: Degree requirements for registered professional nurses. Purpose: To implement chapters 502 of the Laws of 2017 and chapter 380 of the Laws of 2018.

Subject: Professional learning plans. Purpose: To implement Education Law section 3012-e(5)(a)(vii) which requires that LEAs have a process for each classroom teacher and building principal to receive formal support for professional growth annually, along with additional professional learning requirements for certain groups of educators.

Subject: Personal finance education and climate education. Purpose: Ensuring personal finance education and climate education is provided to students in grades kindergarten through 12.

Subject: Comprehensive library board policies. Purpose: To strengthen library governance and accountability across New York’s public and association libraries.

Subject: Regents High School Equivalency (HSE) Exam Pathway. Purpose: Use of regents credit acquired through exemptions from the di- ploma assessment requirements.

Subject: Extending Flexibility for Incidental Teaching. Purpose: Enable school districts to address ongoing staffing challenges by providing them with flexibility in making teaching assignments.

Subject: National Institute of Standards and Technology (NIST) Cyberse- curity Framework (CSF). Purpose: To update the regulations referencing an older version of the NIST CSF and to update an outdated retention policy.

Subject: Special education due process hearings. Purpose: Clarifying the due process rights of parents of students who parentally-place their children in nonpublic schools.

Subject: Transferring of Prescriptions by Pharmacists. Purpose: Require pharmacists and pharmacies to transfer a patient’s entire prescription, including all authorized refills, upon request.

Subject: Supplementary Certificate and Supplementary Bilingual Educa- tion Extension Requirements. Purpose: Provide flexibility for Supplementary Certificate/Supplementary Bilingual Education Extension reqs. due to influx of students.

Subject: Special Subject Tenure Areas. Purpose: Conform regulations to the existing certification structure outlined in Part 80 and reflect current terminology.

Subject: Special education impartial hearing officers (IHOs). Purpose: To amend the definition of an IHO and to clarify the IHO com- plaint process.

Subject: Shared pharmacy services. Purpose: To conform the Commissioner’s regulations with chapter 491 of the Laws of 2024.

Subject: Dual enrollment programs. Purpose: To implement section 319 of the Education Law which directs the Commissioner to adopt a statewide dual enrollment policy.

Subject: Licensing examinations and testing accommodations in the Social Work professions. Purpose: Allow English as a Second Language test accommodations for LMSW and LCSW exams.

Subject: Adding the Master of Public Policy (M.P.P.) Degree as a Registered Degree in New York State. Purpose: To permit New York State degree-granting institutions to offer programs leading to the M.P.P.

Subject: Mandatory Peer Review Program in the Profession of Public Accountancy. Purpose: To conform current state quality controls with national standards.

Subject: Incorporating culturally responsive-sustaining education to teacher preparation program requirements. Purpose: Include culturally responsive-sustaining education practices and pedagogy aligned with the four principles of the CR-SE Framework.

Subject: Coupling in Thoroughbred horse racing. Purpose: To enhance wagering interest in Thorougbred racing.

Subject: Licensing examinations and testing accommodations in the social work professions. Purpose: Allow English as a second language test accommodations for LMSW and LCSW exams.

Subject: Regents High School Equivalency (HSE) Exam Pathway. Purpose: Use of regents credit acquired through exemptions from the di- ploma assessment requirements.

Subject: Use of therapeutic pharmaceutical agents and continuing educa- tion requirements for licensed optometrists. Purpose: Add nasal sprays to list of therapeutic pharmaceutical agents that optometrists are authorized to use to treat dry eye disease.

Subject: Teaching Assistant Certification. Purpose: Establish Initial and Professional TA certificates to replace Level I, II, and III TA certificates.

Subject: Prohibition of corporal punishment and standards for behavioral interventions. Purpose: To align regs with amendments to Education Law section 310 and to indicate behavioral interventions are in accordance with 8 NYCRR 19.5.

Subject: First aid requirements for coaches. Purpose: Clarifying the first aid training coaches must receive and which courses are sufficient for that purpose.
