Rule Making Activitiess

Subject: Proposal to approve the use of previously-authorized funds to extend the existing Make-Ready Program beyond utility plug goals. Purpose: To modify the Make-Ready Program to continue availability of incentives.

Subject: The Community Choice Aggregation Program for municipalities to aggregate electric or natural gas supply for residents. Purpose: To consider whether to modify or discontinue the Community Choice Aggregation Program.

Subject: Direct Load Management (DLM). Purpose: To implement changes to the Direct Load Mangement Program to remain consistent with statewide policy.

Subject: Annual Budget. Purpose: To implement rate adjustments as determined through LIPA’s annual budget process.

Subject: Value of Distributed Energy Resources (VDER). Purpose: To establish a new Retail Storage Performance Component.

Subject: Reconnection Charges and Postpaid Return Envelopes. Purpose: To clarify the Tariff and remove outdated practices.

Subject: Opioid Antagonists in the Workplace. Purpose: To promulgate regulations pursuant to Labor Law, section 27- f(4) regarding opioid antagonists in the workplace.

Subject: Financial Statement Filings and Accounting Practices and Procedures. Purpose: To update reference to the 2026 edition of the NAIC AP&P Man- ual and make non-substantive, technical changes to section 83.4.

Subject: Private Passenger Motor Vehicle Insurance Multi-Tier Programs. Purpose: To repeal regulation made redundant by new Insurance Law sec- tion 2341.

Subject: Risk-Based Capital. Purpose: To eliminate the 1/1/27 sunset date to make permanent the treat- ment of shares of an eligible exchange traded fund as bonds.

Subject: Superintendent’s Hearing. Purpose: Revise description of authorized disciplinary sanctions to provide greater clarity.

Subject: Cases of Incarcerated Individual Misbehavior. Purpose: Clarify standards for representation provided law students at disciplinary hearings.

Subject: Disciplinary Hearings. Purpose: Clarify procedural provisions regarding witness requests and as- signment of assistants.

Subject: Violation Hearings. Purpose: Authorizing hearing officers to impose loss of privileges upon affirming a charge.

Subject: Tuition liability and refunds. Purpose: Amend existing regulations to provide increased flexibility to address student tuition liability in case of undue hardship.

Subject: Transfers of ownership interests in an interstate natural gas pipeline. Purpose: To consider whether the proposed ownership transfers are in the public interest.

Subject: Financial support for the Copenhagen hydroelectric facility. Purpose: To consider whether a contract award is needed to maintain the facility’s renewable output and what level of support is needed.

Subject: Sale of certain real property to Sunrise Mall Holdings II LLC. Purpose: To consider whether the sale of certain real property to the Sunrise Mall Holdings II LLC is in the public interest.

Subject: Prior Approval Review Process. Purpose: To update the Prior Approval Review Process.

Subject: Municipal Consumer Warranty on Emergency Vehicles – Arbitra- tion Program Regulations. Purpose: To promote the independent, speedy, efficient and fair disposi- tion of disputes concerning defective ambulances and fire vehicles.

Subject: Implementation of Part N of Chapter 36 of the Laws of 2019 and Chapter 696 of the Laws of 2022; 352-e(6) and 352-eeee(7) of General Business Law. Purpose: To update regulations in accordance with Part N of Chapter 36 of the Laws of 2019 and Chapter 696 of the Laws of 2022.

Subject: New York State Rural Rental Assistance Program (RRAP) State regulations. Purpose: To update the Rural Rental Assistance Program regulations to conform with long-standing practice.

Subject: Reclassification of Newtown Creek. Purpose: Amend the classification of Newtown Creek from Class SD to Class I.

Subject: Examination of Livestock, Domestic Animal Health Permits, Movement and Transfer of Horses, Vesicular Stomatitis. Purpose: Update regulations based on current science to prevent unneces- sary risk of spread of infectious disease.

Subject: Voluntary Program for the Production of Virus-Tested Plant Materials. Purpose: Amend the testing requirements from twice per growing season to once per growing season.

Subject: Eliminating the bonding requirement for certain mobile homes and modular building units. Purpose: To remove an unnecessary regulatory and administrative burden on the transportation of mobile homes and modular building units.

Subject: Waiver of metering requirements. Purpose: To grant Tunnel to Towers Foundation’s petition for waiver of individual metering requirements.

Subject: Submetering of electricity and waiver request. Purpose: To authorize Third Street Owner LLC’s petition to submeter electricity and granting waiver request.

Subject: Submetering of electricity and waiver request. Purpose: To authorize 77 Water LLC’s petition to submeter electricity and granting waiver request.

Subject: Gas metering equipment. Purpose: To approve Central Hudson’s petition for use of gas metering equipment in New York State.

Subject: Request of NYISO to incur indebtedness. Purpose: To ensure that debt financing is used reasonably and appropriately.

Subject: Submetering of electricity and waiver request. Purpose: To authorize NPSHDFC’s petition to submeter electricity and granting waiver request.

Subject: Independent Dispute Resolution for Emergency Services and Surprise Bills. Purpose: To conform Part 400 to the amendments made by Part BB of chapter 57 of the Laws of 2026.

Subject: Flexible Rating for Nonbusiness Automobile and For Hire Motor Vehicle Insurance Policies. Purpose: To conform to new Insurance Law section 2356(d) and amended section 2350.

Subject: Medical Fee Schedules. Purpose: To update the medical fee schedules used for treatment in work- ers’ compensation claims.

Subject: Divisible Load Permitting. Purpose: To allow for the issuance of divisible load permits to applicants utilizing vehicles validly registered in any jurisdiction.

Subject: Minor rate increase. Purpose: To authorize Freeport Electric’s minor rate increase.

Subject: Gas Demand Response Pilot Program. Purpose: To approve, with modifications, NFG’s Non-Residential Gas Demand Response Pilot Program.

Subject: Regional Residential Weatherization Program. Purpose: To approve, with modifications the Upstate Regional Residential Weatherization Program.

Subject: Regional Residential Weatherization Program. Purpose: To approve, with modifications the Downstate Regional Resi- dential Weatherization Program.

Subject: The applicable regulatory regime under the Public Service Law for the owner/operator of a battery energy storage facility. Purpose: To determine whether a lightened regulatory regime for Zenobe Burns, LLC is consistent with the public interest.

Subject: New York State Reliability Council reliability rules and measurements. Purpose: To consider revisions to various rules and measurements of the New York State Reliability Council used to support safe and reliable electric service.
