Rule Making Activitiess

Subject: Annual Budget Process. Purpose: To implement rate adjustments as determined through LIPA’s annual budget process.

Subject: Sub/Transmission Level Rates and New IA requirement. Purpose: To charge Sub/Transmisison level rates for customers connected to LIPA’s system at 23,000 kVa or higher and new IA requirement.

Subject: Standby Rate and Buyback Services. Purpose: To introduce Standby Rates through Standby Service and update Buyback Service.

Subject: New York State Energy Affordability Guarantee Pilot Program. Purpose: To implement the New York State EAG Pilot program in the LIPA service territory.

Subject: ReCharge New York. Purpose: To implement ReCharge New York for non-net metered customers.

Subject: Onsite Wastewater Treatment System Waiver Requirements. Purpose: Clarify availability of waivers from statewide requirements regarding installation and operation of wastewater treatment systems.

Subject: Enteral Nutrition Defined Benefit Changes. Purpose: To increase the enteral nutrition oral supplementation defined benefit calorie limit.

Subject: Special education impartial hearing officers (IHOs). Purpose: To amend the definition of an IHO and to clarify the IHO com- plaint process.

Subject: Shared pharmacy services. Purpose: To conform the Commissioner’s regulations with chapter 491 of the Laws of 2024.

Subject: Dual enrollment programs. Purpose: To implement section 319 of the Education Law which directs the Commissioner to adopt a statewide dual enrollment policy.

Subject: Statewide Protocols for Diapering and Toileting. Purpose: To implement chapter 361 of the Laws of 2024.

Subject: Outreach for the supplemental nutrition assistance program. Purpose: To implement part B of chapter 56 of the Laws of 2025.

Subject: Supplementary Certificate and Supplementary Bilingual Educa- tion Extension Requirements. Purpose: Provide flexibility for Supplementary Certificate/Supplementary Bilingual Education Extension requirements due to influx of students.

Subject: Technical Amendment of section 52.21. Purpose: To correct the numbering of the technical amendments in the February 2025 permanent rule.

Subject: Performance-Based Learning and Assessment Networks (PLAN) Pilot Program. Purpose: To establish an application process for regulatory flexibility for schools participating in the PLAN pilot program.

Subject: Licensing examinations and testing accommodations in the Social Work professions. Purpose: Allow English as a Second Language test accommodations for LMSW and LCSW exams.

Subject: Adding the Master of Public Policy (M.P.P.) Degree as a Registered Degree in New York State. Purpose: To permit New York State degree-granting institutions to offer programs leading to the M.P.P.

Subject: Mandatory Peer Review Program in the Profession of Public Accountancy. Purpose: To conform current state quality controls with national standards.

Subject: Incorporating culturally responsive-sustaining education to teacher preparation program requirements. Purpose: Include culturally responsive-sustaining education practices and pedagogy aligned with the four principles of the CR-SE Framework.

Subject: Proposed amendments to the traffic and parking regulations at State University of New York at Canton. Purpose: To amend existing regulations to update traffic and parking regulations.

Subject: Waiver of 16 NYCRR Sections 86.3(a)(2), (b)(1), (2) and 88.4(a)(4) Purpose: To consider a waiver of Article VII requirements relating to the content of the application for transmission line siting.

Subject: Proposed major rate increase in NYSEG’s annual gas revenues by approximately $93 million. Purpose: To ensure safe and adequate service at just and reasonable rates charged to customers without undue preferences.

Subject: Proposed major rate increase in RG&E’s annual gas revenues by approximately $72.9 million. Purpose: To ensure safe and adequate service at just and reasonable rates charged to customers without undue preferences.

Subject: Proposed major rate increase in RG&E’s annual electric revenues by approximately $220.2 million. Purpose: To ensure safe and adequate service at just and reasonable rates charged to customers without undue preferences.

Subject: Proposed major rate increase in NYSEG’s annual electric revenues by approximately $464.4 million. Purpose: To ensure safe and adequate service at just and reasonable rates charged to customers without undue preferences.

Subject: Applicable regulatory regime for the owner and operator of a solar-powered generating facility. Purpose: To determine whether a lightened regulatory regime for Oxbow Hill is consistent with the PSL.

Subject: Reports of Suspected Insurance Frauds to Criminal Investiga- tions Unit; Required Warning Statements. Purpose: To change the month to file a required annual report from Janu- ary to March to be consistent with statute.

Subject: Sullivan Correctional Facility. Purpose: Repeal section pertaining to Sullivan Correctional Facility which was closed in 2024.

Subject: Great Meadow Correctional Facility. Purpose: Repeal section pertaining the Great Meadow Correctional Facil- ity which was closed in 2024.

Subject: Coupling in Thoroughbred horse racing. Purpose: To enhance wagering interest in Thorougbred racing.

Subject: Financial accountability methods for Energy Brokers and Energy Consultants. Purpose: To further implement the provisions of Public Service Law Sec- tion 66-t.

Subject: Petition to submeter electricity and waiver of energy audit requirement. Purpose: To ensure adequate submetering equipment, consumer protec- tions and energy efficiency protections are in place.

Subject: Agreement for the provision of water service and waivers. Purpose: To consider whether the terms of a water main extension agree- ment and requested waivers are in the public interest.

Subject: Community Distributed Generation (CDG). Purpose: To consider rehearing of the Commission’s July 17, 2025 order.
