Rule Making Activitiess

Subject: Timeline for initial enrollment or reentry identification and par- ent notification, orientation, and placement of ELLs. Purpose: To provide that the Commissioner may allow school districts to seek an extension of the 10-day timeline for identification and placement of ELLS where exigent circumstances exist.

Subject: Requirements for restricted licenses for clinical laboratory technologists in molecular testing. Purpose: To implement chapter 186 of the Laws of 2023.

Subject: Fees for certificates of existence and copies of charter actions and consent to incorporation. Purpose: To require a fee for certificates of existence and copies of charter actions and to update regulatory provisions regarding consent to incorporation.

Subject: Computer science tenure area. Purpose: To extend the dates listed in the computer science tenure regula- tions by one year from September 1, 2023 to September 1, 2024, aligning the date with the Computer Science SOCE application deadline and the date by which teachers of computer science courses need to hold the Com- puter Science certificate or SOCE.

Subject: Regents accreditation. Purpose: To repeal regulatory provisions related to Board of Regents Ac- creditation since the Board is no longer recognized as an institutional ac- crediting agency.

Subject: General misconduct provisions for the health professions and requirements for histotechnologist licensure. Purpose: To implement section 10 of chapter 446 of the Laws of 2022.

Subject: Provisions for mergers, consolidation, and membership with highly qualified out-of-state institutions of higher education (IHE). Purpose: To eliminate unnecessary hurdles for mergers, consolidation, and membership between in-state independent not-for-profit IHEs and highly qualified out-of-state independent/not-for-profit IHEs.

Subject: Education requirements for registration of curricula of licensure qualifying education programs for the professions of clinical laboratory technologist, cytotechnologist, clinical laboratory technician, histotechni- cian, and histotechnologist. Purpose: Conforms the Commissioner’s regulations to Chapter 446 of 2022 by establishing registration of curricula requirements that are aligned to the multiple pathways that lead to licensure in the clinical laboratory professions.

Subject: Civil Penalties for violations of Executive Law section 609 relat- ing to manufactured housing. Purpose: To implement the provisions of article 21-B of the Executive Law as amended by chapter 601 of the Laws of 2023.

Subject: Workload reduction. Purpose: To update various rules regarding the certification or approval of foster family boarding homes.

Subject: Standard Utility Allowances (SUAs) for the Supplemental Nutri- tion Assistance Program (SNAP). Purpose: These regulatory amendments set forth the federally-approved SUAs for the SNAP as of 10/1/2023.

Subject: RG&E’s 2024 Electric Emergency Response Plan. Purpose: To consider the adequacy of RG&E’s proposed 2024 Electric Emergency Response Plan.

Subject: Pole attachment charges. Purpose: To provide pole attachment services at just and reasonable rates.

Subject: NYSEG’s 2024 Electric Emergency Response Plan. Purpose: To consider the adequacy of NYSEG’s proposed 2024 Electric Emergency Response Plan.

Subject: O&R’s 2024 Electric Emergency Response Plan. Purpose: To consider the adequacy of O&R’s proposed 2024 Electric Emergency Response Plan.

Subject: Request to defer cost of a Cost of Service and Rate Model Study. Purpose: To determine whether FIEC can defer the cost of a Cost of Ser- vice and Rate Model Study.

Subject: Insurance Identification Cards and Motor Vehicle Liability Insur- ance Reporting. Purpose: To expand the definition of insurance company to include certain risk retention groups.

Subject: Provide Aid to New York City for Air Pollution Work; Alerts of Air Quality Episodes and Facility-Specific Emission Limit. Purpose: Repeal obsolete rules and make attendant revisions.

Subject: Part 356 Probation Services for Article 3 Juvenile Delinquency. Purpose: Update existing rule to reflect statutory changes and to effectu- ate best practices in preliminary probation procedures.

Subject: Submetering of electricity and waiver request. Purpose: To approve Gowcan’s notice of intent to submeter electricity and waiver request.

Subject: Access to the Records of the Office of Information Technology Services. Purpose: To modernize the process for access to the records of the Office of Information Technology Services.

Subject: Updated citations to New York State electronic notary regulations. Purpose: To reflect the new electronic notary law and regulations issued by the Department of State in 19 NYCRR 182.

Subject: Network Adequacy and Access Standards for Behavioral Health Services. Purpose: To establish network adequacy and access standards for behavioral health services.

Subject: Uses of fluorinated greenhouse gases including sulfur hexafluo- ride in gas-insulated electrical equipment. Purpose: Reduce greenhouse gas emissions as required by the Climate Leadership and Community Protection Act.

Subject: Update to Part 494 Hydrofluorocarbon Standards and Reporting. Purpose: Reduce greenhouse gas emissions as required by the Climate Leadership and Community Protection Act.

Subject: Appraisal Standards. Purpose: To adopt the 2024 edition of the Uniform Standards of Profes- sional Appraisal Practice.

Subject: Use of body imaging scanning equipment. Purpose: To establish regulations for the use of body imaging scanning equipment to screen visitors and incarcerated individuals.

Subject: Expansion of eligibility for child care assistance program. Purpose: To implement changes to the child care assistance program set forth in chapter 56 of the Laws of 2023.

Subject: Definition; individuals designated as officials of the Department of Corrections and Community Supervision. Purpose: To add the Director of Prison Rape Elimination Act Compliance and Assistant Director of the Training Academy as officials.

Subject: Applicability of Title. Purpose: Update the agency name of the Department and remove an outdated reference to regulations of the State Commission of Correction.
