Rule Making Activitiess

Subject: Recreational shark management. Purpose: To protect prohibited sharks from harvest and establish gear restrictions and handling requirements.

Subject: Student teaching requirements for registered teacher preparation programs and through the individual evaluation pathway. Purpose: To extend for one year the timeline for programs to implement the new student teaching requirements, and to make amendments to such requirements and the student teaching requirements for the individual evaluation pathway to certification.

Subject: New York State Learning Standards. Purpose: Updating to Reflect Current New York State Learning Standards.

Subject: Licensing examination and testing accommodations in the profes- sion of architecture. Purpose: To conform NYS architecture licensure requirements with national standards set by the National Council of Architectural Registra- tion Boards by amending the examination content requirements and reten- tion of credit provisions for the Architect Registration Examination and permit ESL testing accommodations.

Subject: Extending a flexibility for incidental teaching. Purpose: To extend flexibility for incidental teaching through the 2023- 2024 school year.

Subject: Employment of substitute teachers. Purpose: To make permanent substitute teaching flexibility for school districts and BOCES.

Subject: Pilot P-20 Partnerships for Principal Preparation Program. Purpose: To extend the September 30, 2022 end date of the pilot program to September 30, 2025.

Subject: Special education due process system procedures. Purpose: To implement the Department’s and the New York City Public Schools’ (NYCPS) Memorandum of Agreement (MOA) with New York City’s Office of Administrative Trials and Hearings (OATH) to establish an administrative team of full-time impartial hearing officers.

Subject: Educator certification for candidates from another state or terri- tory of the United States or the District of Columbia. Purpose: To streamline the endorsement and comparable program pathways providing additional flexibility and increasing the pool of candidates.

Subject: Continuing education requirements for licensed optometrists cer- tified to prescribe and use therapeutic pharmaceutical agents. Purpose: To implement section 9 of chapter 506 of the Laws of 2021.

Subject: Amendments to the Box Tree Moth Quarantine. Purpose: To expand the BTM quarantine to include additional counties, require pre-notification of certain shipments, and add an exemption.

Subject: 2023 National Institute of Standards and Technology (‘‘NIST’’) Handbook 44. Purpose: To incorporate provisions of the 2023 Edition National Institute of Standards and Technology Handbook 44.

Subject: Interviews, screenings and assessments for determining eligibil- ity for public assistance (PA) by telephone or other digital means at PA ap- plicant’s or recipient’s request. Purpose: To update State regulations relative to such interviews, screen- ings and assessments consistent with applicable State law.

Subject: Fuel use tax on motor fuel and diesel motor fuel and the art. 13-A carrier tax jointly administered therewith. Purpose: To set the sales tax component and the composite rate per gallon for the period July 1, 2023 through September 30, 2023.

Subject: Adding Aerosol Cans and Paint to NYS Universal Waste Rule. Purpose: Add Federal universal waste provisions relating to aerosol cans and allow waste paint to be managed as a universal waste.

Subject: Pharmacy Benefits Bureau, Pharmacy Benefit Manager Assess- ments, Filings and Other Requirements for Issuance et al. Purpose: To establish rules for PBMs regarding assessments, license requirements, reporting and record keeping, and to clarify definitions.

Subject: The applicable regulatory regime under the Public Service Law for the owner of an energy storage facility. Purpose: Consideration of a lightened regulatory regime for the owner of an approximately 110 MW energy storage facility.

Subject: Demand Charge Rebate and draft tariff leaves. Purpose: To consider Demand Charge Rebate design characteristics and program operations and associated draft tariff leaves.
