Rule Making Activitiess

Subject: Application of the Public Service Law to owners of a proposed project connecting Sunrise Wind Farm to New York’s electric grid. Purpose: To determine whether to apply a lightened regulatory regime to the owners of the proposed multi-part project.

Subject: Transfer of electric facilities. Purpose: To determine whether to authorize the transfer electric facilities and the proper accounting for the transaction.

Subject: Proposal by electric utilities for a coordinated grid planning process. Purpose: To idenitfy local transmission investments necessary to achieve the the State’s clean energy and climate goals.

Subject: The New York State Standardized Interconnection Requirements. Purpose: To clarify and improve the process for distributed generation and energy storage projects interconnecting to utility systems.

Subject: Gas metering equipment. Purpose: To consider use of volume corrector and ensure that consumer bills will be based on accurate measurements of gas usage.

Subject: Updates to guidance for electric utility Distributed System Implementation Plans (DSIPs). Purpose: Development of updated guidance and directives for utility DSIPs for improving utility planning and operations functions.

Subject: Mpox to the List of Sexually Transmitted Diseases (STDs). Purpose: To add Mpox to the list of sexually transmitted diseases (STDs).

Subject: License fee for additional gaming facility. Purpose: To establish a license fee for additional gaming facilities.

Subject: Minimum capital investment for additional gaming facility. Purpose: To establish a minimum capital investment amount for additional gaming facilities.

Subject: Peekamoose Valley Riparian Corridor. Purpose: To protect public health, safety, general welfare and natural re- sources on the Peekamoose Valley Riparian Corridor.

Subject: Adjudicatory proceedings and appeals procedures for matters under the Commission’s jurisdiction. Purpose: To streamline and advance the investigative process and thereby facilitate the expeditious and efficient performance of the Commission on Ethics and Lobbying in Government’s investigative and enforcement duties as set forth in Section 94 of the Executive Law.

Subject: Execution by registered professional nurses of non-patient specific orders to administer COVID-19 and influenza tests. Purpose: To implement part C of chapter 57 of the Laws of 2022.

Subject: Universal Prekindergarten Program (UPK) Staffing Qualifications. Purpose: To conform the Commissioner’s regulations to part A of chapter 56 of the Laws of 2022.

Subject: School safety plans. Purpose: To conform the regulations to the amendments made to Educa- tion Law section 2801-a by chapter 227 of the Laws of 2022.

Subject: Independent nurse practitioner practice. Purpose: To implement part C of chapter 57 of the Laws of 2022.

Subject: Degree and experience requirements for college professors for the Tran G Certificate and the Individual Evaluation Pathway. Purpose: To amend degree and experience requirements for college professors for the Transitional G certificate and through the individual evaluation pathway to certification.

Subject: Laboratory experience required to take a science Regents examination. Purpose: To permit students to satisfy laboratory requirement through a combination of hands-on and simulated laboratory experience.

Subject: Appeals to the Commissioner of Education under Education Law section 310. Purpose: To amend requirements related to form of pleading and to provide for electronic filing, extensions for filing memoranda of law, and confidential resolution conferences, and repeal the provision providing for oral arguments for Appeals to the Commissioner of Education under Education Law § 310.

Subject: Remote Instruction and its Delivery Under Emergency Condi- tions and Length of School Day for Approved School-Age and Preschool Programs Serving Students with Disabilities. Purpose: To permit approved school-age and preschool programs serving students with disabilities to provide remote instruction on days they would otherwise close due to an emergency and to count such instructional days towards minimum requirements, and to amend the definition of length of school day for such schools and programs.

Subject: Instruction provided to students in a home, hospital, or institu- tional setting other than a school (homebound instruction). Purpose: To provide clarity as to the circumstances under which home- bound instruction may be requested and delivered.

Subject: Special education due process system procedures. Purpose: To implement the Department’s and the New York City Depart- ment of Education’s (NYCDOE) Memorandum of Agreement (MOA) with New York City’s Office of Administrative Trials and Hearings (OATH) to establish an administrative team of full-time impartial hearing officers.

Subject: Removes requirement that a postdoctoral general practice or specialty dental residency program experience be clinically based. Purpose: To implement chapter 613 of the Laws of 2022.

Subject: Educator certification for candidates from another state or terri- tory of the Untied States or the District of Columbia. Purpose: To streamline the endorsement and comparable program pathways providing additional flexibility and increasing the pool of candidates.

Subject: Continuing education requirements for licensed optometrists cer- tified to prescribe and use therapeutic pharmaceutical agents. Purpose: To implement section 9 of chapter 506 of the Laws of 2021.

Subject: Advertising licensed activity of installing, servicing, or maintain- ing security or fire alarm systems. Purpose: To provide multi-state security or fire alarm system license hold- ers flexibility to making certain disclosures.

Subject: Notaries public. Purpose: To set standards relating to the performance of notarial acts, including electronic notarial acts.

Subject: Transfer of ownership interests in real estate and other property. Purpose: To approve a transfer of ownership interests in real estate and other property from AGTP to Beacon Wind Land.

Subject: Updated recommendations for the solicitation, procurement, and/or installation of qualified energy storage systems. Purpose: To encourage energy storage deployment and establish an updated 2030 target and deployment program.

Subject: Rates for the Sale of Power and Energy. Purpose: Maintain system’s fiscal integrity. This increase in rates does not result from Power Authority’s rate increase to the Village.

Subject: Special licenses and permits; Marine Resources licenses and permits - Uniform Procedures. Purpose: Improve clarity and consistency in issuance and management of marine resources and special licenses and permits.

Subject: Requirements for members of the standing committee for the Regents examination appeals process. Purpose: To provide flexibility on who may serve as a member of the standing committee for the Regents examination appeals process.

Subject: The practice of registered dental assisting. Purpose: To conform the Commissioner’s regulations with chapter 512 of the Laws of 2022 and chapter 390 of the Laws of 2019.

Subject: Restarting the Accountability System Using 2021-2022 School Year Results. Purpose: To align the Commissioner’s regulations with approved state plan addendum and with provisions related to restart of the accountability system.

Subject: New York State Uniform Fire Prevention and Building Code (Uniform Code). Purpose: To amend the existing Uniform Code to amend provisions relat- ing to hot tubs and spas.

Subject: Fees (the maximum fee that may be charged by licensed check cashers for cashing checks for retail consumers). Purpose: To change the annual adjustment of maximum fees and create lower limits for government benefit checks.

Subject: Virtual Currency Licensee Assessments. Purpose: To set forth the basis for allocating costs and expenses attribut- able to virtual currency businesses for FSL assessments.

Subject: Registration of Pharmacy Benefit Managers. Purpose: To maintain status quo while the Department promulgates per- manent regulations under Public Health Law section 280-a.

Subject: Medication assisted treatment. Purpose: Set minimum standards for a program of medication assisted treatment in jails.

Subject: Standard Utility Allowances (SUAs) for the Supplemental Nutri- tion Assistance Program (SNAP). Purpose: These regulatory amendments set forth the federally-approved SUAs for the SNAP as of 10/1/22.

Subject: Notice of intent to submeter electricity. Purpose: To ensure adequate submetering equipment and consumer protections are in place.

Subject: Proposed major rate increase in Con Edison’s annual revenues by $137 million. Purpose: To ensure safe and adequate service at just and reasonable rates charged to customers without undue preferences.

Subject: Notice of intent to submeter electricity and waiver request. Purpose: To ensure adequate submetering equipment, consumer protec- tions and energy efficiency protections are in place.

Subject: Long-term gas system planning. Purpose: To consider and review long-term gas system planning.

Subject: Compensation of and incentives for distributed energy resources. Purpose: To encourage the development of and ensure just and reasonable rates for distributed energy resources.

Subject: Rules of conduct for persons entering and using Grand Central Madison Terminal and its related facilities. Purpose: To facilitate the proper use of Grand Central Madison Terminal and ensure the safety of employees, customers and the public.
