(2) The department may transfer to the fund amounts not to exceed $250,000 from funds available to the department. Moneys in the fund are continuously appropriated to the department to:
(a) Make advances under ORS 456.559 (1)(d) or 456.710; and
(b) Pay expenses incurred by the department in carrying out ORS 456.548 to 456.828; however, any such funds expended by the department under this paragraph must be repaid by the department into the fund from the fees and charges collected under ORS 456.625 (3) and from any other moneys available for such repayment in accordance with ORS 456.548 to 456.828. Sec. 9. Housing Acquisition Fund. (1) The Housing Acquisition Fund is established in the State Treasury, separate and distinct from the General Fund. Interest earned by the Housing Acquisition Fund must be credited to the fund. The Housing Acquisition Fund consists of moneys appropriated, allocated, deposited or transferred to the fund by the Legislative Assembly or otherwise and interest earned on moneys in the fund.
(2) Moneys in the fund are continuously appropriated to the Housing and Community Services Department to provide funding for loans to purchasers of land for affordable housing and naturally occurring affordable housing. [2019 c.671 §9; 2021 c.678 §16]
