Penalty for failure to pay usage charge

Section effective July 1, 2027. See, also, section 57-5-1490 effective until July 1, 2027. Any person who uses any choice lane facility and fails or refuses to pay any usage charge then due shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not more than two hundred dollars or by imprisonment for not more than thirty days, and in addition thereto the department shall have a lien upon the vehicle driven by such person for the amount of such usage charge and may take and retain possession thereof.
