12 V.I.C. § 716

(1) It is unlawful for any person to violate any provision of this chapter or any rule, regulation or order of the Department made hereunder. Violation shall be punishable by a civil penalty of up to $50,000 to be assessed by the Department. Each day during any portion of which the violation occurs constitutes a separate offense.

(2) Penalties assessed herein for a discharge shall be the only penalties assessed by the territory, and the assessed person or persons shall be excused from paying any additional penalty for water pollution assessable under chapter 7 of this title for the same occurrence.

(3) The penalty provisions of this section shall not apply to any discharge promptly reported and removed by a licensee in accordance with the rules, regulations and orders of the Department.
