A defendant found guilty of an offense, or the defendant’s attorney or the Attorney General, not later than 10 days after the defendant is found guilty, and prior to the time the defendant is sentenced, may file a motion for a hearing on the present mental condition of the convicted person. The motion must be supported by information indicating that the convicted person may presently be suffering from a behavioral disorder, mental health disorder, and the basis for the request for the treatment of which the convicted person is in need of custody for care or treatment in a suitable facility.
