19 V.I.C. § 1033

When the administrator of the facility in which the convicted person is hospitalized determines that the convicted person has been stabilized and is compliant with the treatment for their behavioral disorder or mental health disorder to such an extent that the person is no longer in need of custody for care or treatment in such a facility, the administrator shall promptly file a certificate to that effect with the clerk of the court that ordered the commitment. If at the time of the filing of the certificate, the provisional sentence imposed has not expired, the court may proceed to sentencing or the convicted person shall finish his term of incarceration.
