(a) The Department of Public Works shall establish procedures and minimum standards for the paving and construction of high quality roads in the Virgin Islands. The Commissioner of the Department of Public Works shall assign a minimum of two civil engineers to establish the procedures and standards. The procedures must be reviewed and revisited from time to time by the required team of engineers and updated on an annual basis.
(b) If expertise outside the Department of Public Works is needed, then the Commissioner shall seek an appropriation of funds from the Legislature to hire additional civil engineers to carry out this section.
(c) The team of engineers shall establish the processes and techniques that must be used for mounting, grading and aggregating the roads.
(d) Violation of this section subjects the violating contractor to the requirement to redo the project at no cost to the Government.
