Determining whether authorization exists; burden on insurance producer

22 V.I.C. § 756

(1) Any insurance producer soliciting, negotiating, or procuring an application for insurance or health care services in the Territory must make a good faith effort to determine whether the entity that is issuing the coverage is:(1) authorized as an admitted insurer to transact health insurance coverage in this Territory; or(2) a property or casualty insurer, conducting business as an admitted insurer or through a surplus line broker licensed under chapter 27 of this title.
