Good faith efforts

(a) Nothing in this chapter may be construed to impose criminal liability on a person who has made a good faith effort to assist the older or dependent adult in the management of older or depend adult’s property but, through no fault of the assisting person, the assisting person has been unable to provide such assistance. Proof of stated good faith efforts must be properly documented.

(b) For purposes of this section, good faith effort means the honest intent to act without taking an unfair advantage over an older or dependent adult, or to fulfill a promise to act, even when some legal technicality is not fulfilled.
