(1) An action may be maintained in the name of the government of the Virgin Islands upon the information of the Attorney General of the Virgin Islands or upon the relation of a private person against the person offending in the following cases:(1) When any person shall usurp, intrude into, or unlawfully hold or exercise any public office, or any franchise within the Virgin Islands, or any office in a corporation, either public or private, created or formed by or under the authority of the Virgin Islands; or,(2) When any public officer has done or suffered an act to be performed which, by the provisions of law, makes a forfeiture of his office; or,(3) When any association or number of persons acts within the Virgin Islands as a corporation without being duly incorporated.
