    Poland Spring water (now owned by Primo Brands) has been the subject of a long-running class action lawsuit (filed 2003 in Connecticut federal court, settled 2022) alleging that Poland Spring water did not meet the FDA definition of spring water — specifically that the water was extracted from groundwater wells, not from a naturally occurring spring as required by law. The settlement included $12.5 million payment and label changes but did not admit liability. The FDA spring water definition requires the water to flow naturally to the surface or be accessed via a borehole at the actual spring location. The case highlighted that US bottled water labeling standards allow significant flexibility in sourcing claims. Meanwhile, Nestlé sold the entire US spring water portfolio (Poland Spring, Deer Park, etc.) for $4.3 billion in 2021 — exiting the US bottled water market as ESG pressure made single-use plastic a reputational liability for a Swiss company that sells baby formula and pet food in the same year it bottled water in plastic.
