Title 10 › Subtitle A — General Military Law › PART II — PERSONNEL › CHAPTER 57 — DECORATIONS AND AWARDS › § 1128
The Secretary in charge must give a prisoner-of-war medal to any service member who was captured and held prisoner while fighting an enemy, during military operations against a foreign force, or while serving with friendly forces in a conflict where the United States was not a belligerent. Under rules set by the Secretary of Defense, the Secretary may also award the medal for other captivity situations that are found to be comparable to those kinds of enemy imprisonment. The medal will have an appropriate design with ribbon and attachments. It ranks right after individual heroism or meritorious decorations and before service or campaign medals. Only one medal is issued to a person, but devices may be added for later qualifying service. The person’s conduct during captivity must have been honorable. If the person dies before getting the medal, it may go to their representative. Lost or damaged medals may be replaced at no cost if the person was not at fault. The Secretary of Defense must try to keep the rules the same across the services.
