To join the Army National Guard of the United States or the Air National Guard of the United States, a person must already be enlisted in the state Army or Air National Guard, take the oath found in title 32 section 304, and be a member of a federally recognized unit at the rank they will hold as a Reserve. Under rules set by the Secretary of the Army or the Secretary of the Air Force, enlisting in or extending service in a state Guard also enrolls or extends that person as a Reserve of the Army or Air Force for service in the National Guard of the United States. If an Army Reserve or Air Force Reserve member enlists in the state Guard at their reserve rank and is in a federally recognized unit, they become a member of the National Guard of the United States and leave their Reserve.
