Use the full basic pay rates from October 1, 2006 through December 31, 2014 when figuring the retired-pay base for certain generals and admirals. Do not count any pay reductions made by section 203(a)(2) of title 37 for that period when you calculate their retired pay. If an officer was moved to the Retired Reserve between October 1, 2006 and December 31, 2014 and only becomes entitled to retired pay after December 31, 2014 under section 12731, use the unreduced pay rates too. If the officer first became a service member before September 8, 1980 and retires or transfers to the Retired Reserve after December 31, 2014, their retired-pay base can instead be figured using the basic pay rate and years of service as of December 31, 2014 for their grade, also ignoring section 203(a)(2), if that gives a higher result. If their retired grade is lower than the grade they held on December 31, 2014, treat them as if they held the retired grade on that date. A “covered general or flag officer” means someone who after September 30, 2006 is retired in — or transferred to the Retired Reserve in — a general or flag officer grade (including equivalent grades in the Public Health Service or NOAA).
