Promotion boards must pick the officers they think are best qualified for promotion in each group they review or to fill a vacancy. When choosing, the board must consider the service’s need for officers with particular skills shown in the board’s guidelines. A board cannot recommend an officer unless a majority of members vote to recommend that officer, a majority finds the officer fully qualified, and a majority, after reviewing any negative information given to the board, finds the officer among the best qualified and meeting the law’s standard for exemplary conduct. A reserve active-status officer generally cannot be promoted under chapter 1405 unless considered and recommended by such a board or a special selection board. Board recommendations are secret until every member signs the written report and can only be released under Secretary of Defense rules. The Secretary or anyone who supervises board members may not punish or improperly influence the board. If the Secretary allows it, the board may recommend that certain promoted officers of special merit be placed higher on the promotion list, but that requires the same majority vote (or an alternative rule provided to the board), and the board must suggest the order for those officers.
